[Word] Nykomb Synergetics Development AB response to Business & Human Rights Resource Centre following the complaint filed by two Senegalese NGOs for non compliance with the OECD Guidelines for multinational enterprises

  1. [The information in the press releases of these 2 Senegalese NGOs is a misrepresentation of facts and their complaint is directed at the wrong company i.e Nykomb Synergetics AB which has never had any link with the power project. I have received the complaint from you as chairman of the board of a company called Nykomb Synergetics Development AB. 
  2. The company executing and owning the power plant (and who will also operate the power plant after its construction) is Compagnie d´Électricité du Senegal SA ("CES"). The NGOs´ complaint should be directed to that company and its management held responsible in the event the complaint is proven to be justified. 
  3.     We do not have access to any information from CES regarding the ongoing construction of the Sendou power plant and cannot assess if the current Administrateur Général is in compliance with the provisions of the final ESIA submitted by CES (following public hearings) and related permits granted to CES by the Senegalese authorities. 
  4. 4.   If however to be addressed on the merits,  the preparation of the ESIA for CES which occurred in 2008/3009 was carried out in full compliance with requisite standards and norms, as vetted by local and international experts. The ESIA does nowhere emphasize significant adverse social and environmental impacts].
