Peru: New declaration of state of emergency in area of operation of Chinese mining company Las Bambas

"The State has decreed a state of emergency in the roadway corridor to combat social protest, but it has not taken a position on the reclassification of roads that favour the roadway corridor," says Juan Carlos Ruiz of the IDL's Constitutional Litigation and Indigenous Peoples Area...The lawyer wonders why the Ministry of Transport and Communications has turned the communal dirt roads into national roads, without first respecting the right to prior consultation or the communities' right to property over them.  This reclassification of roads carried out by the Ministry [MTC] was not consulted with the communities, nor was it done after a land purchase, expropriation, payment of a fair price or prior establishment of rental or mining servitude. Nor does it care that the health of the peasant communities has been affected and the environment polluted by allowing numerous trucks to transit on dusty roads.
