UK Court decision in gold miner’s silicosis cases

London’s High Court today ruled that it had no jurisdiction over claims that had been filed against Anglo American South Africa Ltd (“AASA”). The ruling affects the interests of thousands of South African former gold miners. The judge, Mr Justice Smith, gave permission to appeal the decision to the UK Court of Appeal. However many of the claimants have no option but to discontinue their UK claims and pursue their cases in South Africa…Most of the claimants intend awaiting the outcome of the UK Court of Appeal decision. But for many of the claimants, time has unfortunately run out: if they were continue waiting on the result of an appeal and the appeal was ultimately unsuccessful, they might fall foul of a law that imposes a 3 year time constraint on starting litigation in South Africa.
