1、在UFLPA開始執行後,CBP將根據具體情況審查每批貨物是否落入UFLPA的管轄範圍。如果進口商被告知商品依據UFLPA被扣留(detention)、排除(exclusion)或者扣押(seizure),進口商可以向 CBP 提供清晰且有說服力的證據,要求對 UFLPA 的可反駁推定進行例外處理(exception)。

2、進口商可以提交防止或減輕強迫勞動風險並糾正在開採、生產或製造進口商品時發現的任何強迫勞動的內控措施證據;並且企業經營系統或會計系統(例如經審計的財務報表)必須能夠顯示這些措施的對應信息,即相關措施需要在公司管理系統或會計記錄中有跡可循。

3、UFLPA下的執法機制與CBP此前沿用的WRO是兩個獨立的機制。對於落入UFLPA管轄範圍的商品,CBP將不會印發WRO,而是在逐批商品基礎上進行執法,直接對商品進行扣留、排除、扣押處理,或者對滿足反駁推定標準的商品作例外放行處理。
